Any individual or organization whose privacy rights have been prejudiced with regard to processing of personal data.

What is the task of the Commissioner when she receives a complaint under the DPA.

Where a complaint is made to the Commissioner under the DPA, the Commissioner has the duty to investigate the complaint or cause it to be investigated by an authorised officer, unless she is of the opinion that such complaint is frivolous or vexatious; and as soon as reasonably practicable, notify the complainant in writing of her decision in relation to the complaint and that the complainant may, if he is aggrieved by the Commissioner's decision, appeal to the ICT Appeal Tribunal within 21 days.
